WHEREAS, the traffic evaluation of East Johnstown Road recommends consolidating access from developers; and

WHEREAS, the access for the YMCA is at a point which would be also used by future development to the North and West; and

WHEREAS, there has been discussion about making the access a public street, and the Administration is recommending that we move forward with this; and

WHEREAS, since the YMCA is ready to begin work due to the construction season it is imperative to move forward with this legislation all for the preservation of the public peace, health, safety and welfare;

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:

Section 1. That the Mayor is hereby authorized to enter into Reimbursement Agreement with the YMCA of Central Ohio, Inc., 1700 South 20th Street, Columbus, Ohio 43207, for partial payment for construction of a public street; Improvement No. 825; Agreement attached hereto as EXHIBIT A.

Section 2. That funding in the amount of ONE HUNDRED FORTY FIVE THOUSAND DOLLARS ($145,000) is hereby supplementally appropriated from the unencumbered, unappropriated balance of the General Fund to Account No. 101.145.5541, Capital Projects, Streets, to cover the herein costs.

Section 3. That future development will be required to use the new road for access and to reimburse the City for costs of the roadway.

Section 4. That ORD-0001-2002, passed January 2, 2002, is hereby amended to reflect this supplemental appropriation.

Section 5. That waiver of second reading has been requested.

Section 6. That, for the reasons set forth in the preamble herein above, this ordinance is declared emergency legislation ...
