TO ACCEPT THE FINAL DEVELOPMENT PLAN FOR PROPERTY LOCATED AT 1341 CHERRY WAY, KINDERCARE LEARNING CENTERS INC; AND TO DECLARE AN EMERGENCY.
BODY
WHEREAS, Kindercare Learning Centers, Inc., has submitted to the City the Final Development Plan for property consisting of 2.21 acres located at 1341 Cherry Way; and
WHEREAS, Planning Commission, on February 11, 1998, after study and review, has recommended to Council the approval of this Final Development Plan; and
WHEREAS, the building season is upon us and the applicant wishes to begin construction as soon as possible in order to provide this needed service to the community and all for the preservation of the public peace, health, safety and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That the Kindercare Learning Centers, Inc., Final Development Plan, consisting of 2.21 acres at 1341 Cherry Way, meets all requirements of the Planned Commercial Center zoning approved by the City in prior actions.
Section 2. That the City Engineer has certified that Kindercare Learning Centers Inc will meet all requirements of storm water and design requirements for adequate on site drainage and the ability to accept runoff from land tributary to the development.
Section 3. That all requirements of Section 1167.21, Preservation Zones, of the Codified Ordinances shall be adhered to for the areas so designated on this Final Development Plan.
Section 4. That said Final Development Plan is attached to this ordinance as EXHIBIT A and made a part herein.
Section 5. That, for the reasons set forth in the preamble hereinabove, this ordinance is declared emergency legislation, and shall be in full force and effect immediately upon passage by this Council and approval by the Mayor.
