TO AUTHORIZE THE MAYOR TO ENTER INTO CONTRACT WITH FACEMYER COMPANY FOR THE TECHCENTER SLOPE STABILIZATION ST 1037; AND TO DECLARE AN EMERGENCY.

WHEREAS, funding for this project was authorized on August 17, 2015 by ORD-0088-2015; and
WHEREAS, an area of repetitive settlement has been occurring within a fifty foot section of the multi-use path located on the south side of Tech Center Drive as well as a large area of slope failure that is in need of immediate repair; and
WHEREAS, Facemyer Company was the lowest responsive and responsible bidder with a bid of $319,578; and
WHEREAS, the City Engineer is requesting a ten percent contingency to cover any unforeseen construction costs which will bring the total project cost to $351,536; and
WHEREAS, it is imperative to move forward as soon as possible due to the severity of this slope failure, and all for the preservation of the peace, property, health, safety and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, COUNTY OF FRANKLIN, STATE OF OHIO:
Section 1. That the Mayor is hereby authorized to enter into contract with Facemyer Company, 72 Holmes Street, Building C, Galena, Ohio 43021, for repair of the Techcenter Slope Stabilization ST 1037; said contract attached to this Ordinance as EXHIBIT A, and made a part herein.
Section 2. That, for the reasons set forth in the preamble hereinabove, this Ordinance is declared emergency legislation and shall be in full force and effect immediately upon passage by this Council and on date of signature approval by the Mayor.
