WHEREAS, ORD-0002-2006 authorized preliminary legislation to cooperate with the Director of Transportation for the TechCenter Drive West Improvement No. 762; and

WHEREAS, before the project can begin the City of Gahanna must pass legislation required by ODOT as well as a Final Resolution; and

WHEREAS, the Director of Transportation has approved said legislation proposing cooperation and has caused to be made plans and specifications and an estimate of cost and expense for improving the above described highway and has transmitted copies of the same to this legislative authority; and

WHEREAS, the estimated share of the cost for the City is $1,802,972 and is to be paid to ODOT by December 30, 2010; and

WHEREAS, it is imperative to enter into Contract and approve Final Resolution with ODOT and have payment to them by the December deadline so that the project can continue on schedule with construction beginning in the Summer of 2011, and all for the preservation of the public peace, property, health, safety and welfare;

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:

Section 1. That the City of Gahanna shall cooperate with the Director of Transportation in the above described project as follows:
