TO AMEND CODE SECTION 148.12, FEES, OF CHAPTER 148, DEPARTMENT OF PLANNING AND DEVELOPMENT, AND TO REPEAL SECTION 1109.08(k), PARK FEE OF PUBLIC AREAS OF CHAPTER 1109, STANDARDS, OF THE CODIFIED ORDINANCES OF GAHANNA.

WHEREAS, the Department of Planning and Development is recommending an amendment to the Codified Ordinances in regards to park fees; and
WHEREAS, the Department of Planning and Development is requesting Section 1109.08(k) be removed to ensure consistency in enforcing the park fee as recommended under a new section 148.12(c); and
WHEREAS, on June 11, 2014, the Planning Commission met in regular session to review 1109.08(k) and recommended that it be approved by City Council;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, COUNTY OF FRANKLIN, STATE OF OHIO:
Section 1. That Section 148.12(c), Fees, of Chapter 148, Department of Planning and Development, is hereby amended as set forth in EXHIBIT A, attached hereto and made a part herein.
Section 2. That Section 1109.08(k), Park Fee of Public Areas, of Chapter 1109, Standards, is hereby repealed as set forth in EXHIBIT B, attached hereto and made a part herein.
Section 3. That existing Section 1109.08(k), Park Fee of Public Areas, of Chapter 1109, Standards, or any ordinances or parts of ordinances in conflict herewith, is hereby repealed.
Section 4. That this Ordinance shall be in full force and effect after passage by this Council and 30 days after date of signature approval by the Mayor.
