TO AUTHORIZE THE MAYOR TO ENTER INTO DEED OF CONSERVATION EASEMENT WITH HAMILTON ROAD RETAIL, LLC, FOR PROPERTY ALONG HAMILTON ROAD, SOUTH OF MORSE ROAD; AND TO DECLARE AN EMERGENCY.

WHEREAS, the City has received deed of conservation easement for a 1.320 acre tract along Hamilton Road from Hamilton Road Retail; and
WHEREAS, the developer had to relocate the stream to establish the footprint of the shopping center; and
WHEREAS, the stream relocation incorporated some extensive and innovative water quality enhancement features; and
WHEREAS, to meet the Corp of Engineers and EPA requirements the stream must be located in a conservation easement; and
WHEREAS, it is imperative to move forward with this ordinance so that EPA and Corp of Engineers requirements can be met, all for the preservation of the public peace, health, safety and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That the Mayor is hereby authorized to enter into Conservation Easement with Hamilton Road Retail, LLC, for easement along Hamilton Road, south of Morse Road, for the purpose of meeting EPA and Corp of Engineers requirements; deed attached as EXHIBIT A and made a part hereof.
Section 2. That, for the reasons set forth in the preamble herein above, this ordinance is declared emergency legislation and shall be in full force and effect immediately upon passage by this Council and on date of signature approval by the Mayor.
