TO AUTHORIZE THE MAYOR TO GRANT EASEMENT AND RIGHT OF WAY TO COLUMBUS SOUTHERN POWER COMPANY UTILITY SERVICE TO THE SPRINT TOWER AT GAHANNA PARK MAINTENANCE FACILITY NEAR FRIENDSHIP PARK; AND TO DECLARE AN EMERGENCY

WHEREAS, Columbus Southern Power Company has presented Easement and Right of Way to the City of Gahanna in order to lay utility line through an area of near Friendship Park near the Park Maintenance Facilities; and
WHEREAS, in order that the work for the tower and related roadway may proceed in a timely and orderly manner, it is necessary to proceed as rapidly as possible to supply this utility to the tower base, all for the preservation of the public peace, health, safety, and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That the Mayor is hereby authorized to enter into Easement and Right of Way with COLUMBUS SOUTHERN POWER COMPANY, 215 North Front Street, Columbus, Ohio 43215, said proposed Easement and Right of Way attached to this ordinance as EXHIBIT A.
Section 2. That, for the reasons set forth in the preamble hereinabove, this ordinance is declared emergency legislation and shall be in full force and effect immediately upon passage by this Council and approval by the Mayor.
