TO AUTHORIZE THE PLACEMENT OF SIGNAGE WITHIN THE RIGHT OF WAY FOR CREEKSIDE GRILL, 53 GRANVILLE STREET

WHEREAS, the Creekside Grill has made application to the City of Gahanna to allow a sign within the right of way; and

 

WHEREAS, said projecting sign is in the same location as used by the previous two tenants of the building; and

 

WHEREAS, this variance to code is necessary due to the widening of Granville Street several years ago which made the previous signs a non conforming use; and

 

WHEREAS, Planning Commission at their regular meeting held December 5, 2001, recommended to Council that approval be granted for the location of this sign within the right of way; and

 

WHEREAS, the Creekside Grill is aiming to be open before the end of the year and signage is critical to a new business; and

 

WHEREAS, signage approval will aid drivers and pedestrians in finding this new business to our city and it is important to maintain the flow of traffic in that area, all for the preservation of the public peace, health, safety and welfare;

 

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:

 

Section 1.  That under authority of Section 1103.02 this Council hereby concurs with Planning Commission to grant variation from and exception to Section 1165.08(a), Prohibited Uses, to allow a projecting sign to extend into the right of way for property located at 53 Granville Street.

 

Section 2.  That this approval is for the location of the sign only and does not approve the design of the sign which will be reviewed by Planning Commission at a subsequent time.

 

Section 3.  That, for the reasons set forth in the preamble hereinabove, this ordinance is declared emergency legislation and shall be in full force and effect after passage by this Council and on date of signature approval by the Mayor.
