TO AUTHORIZE THE DIRECTOR OF PUBLIC SERVICE TO AWARD AND THE MAYOR TO ENTER INTO CONTRACT WITH M & D BLACKTOP SEALING FOR ACADEMY/WOODSIDE PARK PATH IMPROVEMENTS; IMPROVEMENT NO. 893; AND TO DECLARE AN EMERGENCY.

WHEREAS, bids were opened March 24, 2006 for the Academy/Woodside Park Path Improvements; and
WHEREAS, the Director of Public Service has recommended we proceed with the lowest, most responsive, and responsible, bidder; and
WHEREAS, it is imperative to proceed with these improvements, all for the preservation of the public peace, health, safety and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That the Director of Public Service is hereby authorized to award and the Mayor is authorized to enter into contract with M & D BLACKTOP SEALING, 2020 Longwood Avenue, Grove City, Ohio 43123, for the Academy/Woodside Park Path Improvements, in accordance with bid and City specifications; bid tabs attached as EXHIBIT A.
Section 2. That funding in the amount of FIFTY FIVE THOUSAND DOLLARS ($55,000) was set aside in the 2006 Appropriations, to Account No. 101.431.5511, Capital Projects, Parks, to cover the herein costs.
Section 3. That, for the reasons set forth in the preamble herein above, this ordinance is declared emergency legislation and shall be in full force and effect immediately upon passage by this Council and on date of signature approval by the Mayor.
