WHEREAS, a Deed of Easement for water line utility purposes has been received from 4595 Morse Road LLC, for property on Morse Road; and
WHEREAS, said Deed of Easement was recorded on October 5, 2006 by the Franklin County Recorder's Office; and
WHEREAS, the City Engineer has estimated the value of this easement to be $7,800; and
WHEREAS, said Deed of Easement is now ready for acceptance by the City of Gahanna; and
WHEREAS, it is imperative to move forward with acceptance of this deed all for the preservation of the public peace, health, safety and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That this Council hereby accepts the Deed of Easement from 4595 Morse Road LLC, for property on Morse Road, Enchanted Care Learning Center, to be used for water line utility easement, said land more particularly described in EXHIBIT A attached hereto and made a part herein.
Section 2. That, for the reasons set forth in the preamble herein above, this ordinance is declared emergency legislation and shall be in full force and effect immediately upon passage by this Council and on date of signature approval by the Mayor.
