TO AUTHORIZE THE MAYOR TO ENTER INTO AGREEMENT WITH ADELPHIA BUSINESS SOLUTIONS, FOR PUBLIC RIGHT OF WAY USE; AND TO DECLARE AN EMERGENCY.

WHEREAS, Adelphia Business Solutions has requested that we enter into a Public Right of Way Agreement; and
WHEREAS, it is necessary to proceed at the earliest possible date with this agreement in order to facilitate this telecommunication provider access to our right of way while working on amendment to our current code, all for the preservation of the public peace, health, safety, and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That the Mayor is hereby authorized to enter into agreement with ADELPHIA BUSINESS SOLUTIONS, for the use of the public right of way for telecommunications purposes, said agreement attached hereto as EXHIBIT A, and made a part herein.
Section 2. That, for the reasons set forth in the preamble herein above, this ordinance is declared emergency legislation and shall be in full force and effect immediately after passage by this Council and on date of signature approval by the Mayor.
