TO AMEND CHAPTER 337, SAFETY AND EQUIPMENT, OF THE CODIFIED ORDINANCE OF THE CITY OF GAHANNA, SECTION 337.99, PENALTY.

WHEREAS, the Mayor, City Attorney and members of the Police Commercial Enforcement planning committee have reviewed, initiated changes, and recommended said changes to city Council; and
WHEREAS, it is desirable to increase the penalties to bring violation up to a misdemeanor of the fourth degree and progressing with each offense thereafter with stronger penalties;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO;
Section 1. That Section 337.99, Penalty, of Chapter 337, Safety and Equipment, of the Codified Ordinances of Gahanna, is hereby amended to increase penalties for violators Driving Unsafe Vehicles as follows:
337.99 PENALTY.
(d) Whoever violates Section 337.01 is guilty of a misdemeanor of the fourth degree on a first offense; on a second offense within one year after the first offense, the person is guilty of a misdemeanor of the third degree; and on each subsequent offense within one year after the first offense, the person is guilty of a misdemeanor of the second degree.
Section 2. That existing Section 337.99, Penalty, or any ordinances or parts of ordinances in conflict herewith are hereby repealed.
Section 3. That this ordinance shall be in full force and effect at the earliest period allowed by law.
