TO AUTHORIZE THE MAYOR TO ENTER INTO REIMBURSEMENT AGREEMENT WITH PORTRAIT HOMES - OHIO FOR CONSTRUCTION OF THE REMAINING PORTION OF THE TRIANGLE NORTH SANITARY SEWER, IMPROVEMENT NO. 696; TO SUPPLEMENTALLY APPROPRIATE $43,518; AND TO DECLARE AN EMERGENCY.

WHEREAS, the remaining portion of the Triangle North Sanitary Sewer needs to be built; and
WHEREAS, Portrait Homes - Ohio has agreed to install the sewer across their property and across the frontage of the Mann tract to the Windward Trace pump station; and
WHEREAS, Portrait Homes - Ohio has requested a reimbursement agreement between the City and Portrait Homes; and
WHEREAS, it is imperative to move forward with this legislation at the earliest possible date due to the construction season, all for the preservation of the public peace, health, safety and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That the Mayor is hereby authorized to enter into Reimbursement Agreement with PORTRAIT HOMES - OHIO, for construction of the remaining portion of the Triangle North Sanitary Sewer, Improvement No. 696, in accordance with City specifications.
Section 2. That funding in the amount of FORTY THREE THOUSAND FIVE HUNDRED EIGHTEEN DOLLARS ($43, 518) is hereby supplementally appropriated form the unencumbered, unappropriated balance of the Sanitary Sewer Fund to Account No. 661.360.5533, Capital Projects, Sewer, to cover the herein costs.
Section 3. That ORD-0001-2003, passed January 2, 2003 is hereby amended to reflect this supplemental appropriation.
Section 4. That, for the reasons set forth in the preamble herein above, this ordinance is declared emergency legislation and shall be in full force and effect immediately after passage by this Council and on date of signature approval by the Mayor.
