Title

TO AUTHORIZE THE MAYOR TO ENTER INTO AMENDED CONTRACT WITH ME COMPANIES FOR APPRAISAL, TITLE WORK, NEGOTIATIONS AND RECORDING OF RIGHT OF WAY ACQUISITION FOR PROPERTIES ON OGDEN ALLEY; AND TO DECLARE AN EMERGENCY.

WHEREAS, the City entered into agreement with ME Companies through ORD-0234-2002 for right of way acquisition services for the Ogden Alley Improvement, to include appraisal, title work, negotiations and recording; and

 

WHEREAS, the City entered into extended agreement with ME Companies through ORD-0053-2003 for right of way acquisition services for the Ogden Alley Improvement, to include appraisal, title work, negotiations and recording; and

 

WHEREAS, the City Engineer has realized that an error was made in totalling the amount needed for right of way acquisition in the previous ordinance and additional funds are required for acquisition of right of way; and

 

WHEREAS, it is desirable and prudent to effect this contract at the earliest possible date all for the preservation of the public peace, health, safety and welfare;

 

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:

 

Section 1.  That the Mayor is hereby authorized to enter into extended contract with ME Companies, 635 Brooksedge Boulevard, Westerville, Ohio 43081, for right of way acquisition services for the Ogden Alley Improvement No. 774.

 

Section 2.  That funding in the amount of TWO THOUSAND FIVE HUNDRED DOLLARS ($2,500) has been set aside to Account No. 325.122.5548, Capital Improvement, to cover the herein costs.

 

Section 3.  That for the reasons set forth in the preamble hereinabove, this ordinance is declared emergency legislation and shall be in full force and effect after passage by this Council and upon the date of signature approval by the Mayor.
