TO WAIVE THE REQUIREMENTS OF SECTION 1317.01, COMPLETION OF STREET REQUIRED BEFORE ISSUANCE OF BUILDING PERMIT, RELIEF, OF THE CODIFIED ORDINANCES OF THE CITY OF GAHANNA; FOR THE WOODS AT SHAGBARK BY THE STONEHENGE COMPANY; TO WAIVE SECOND READING THEREFOR; AND TO DECLARE AN EMERGENCY.

WHEREAS, The Stonehenge Company, 41 North High Street, New Albany, OH 43054, has requested relief from the requirements of Section 1317.01 of the Codified Ordinances, and
WHEREAS, The Mifflin Township Fire Department has stated their concerns in writing and The Stonehenge Company has agreed to address each of these concerns; and
WHEREAS, the Gahanna Police Department has stated in writing that they have no objections to the request; and
WHEREAS, the City Engineer and the Building Division have no concerns with this if Council waives the said requirements; and
WHEREAS, due to the impending winter season it is imperative to move forward as quickly as possible, all for the preservation of the public peace, health, safety and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That this Council does hereby waive the requirements of Section 1317.01, Completion of Street Required before issuance of Building Permit; Relief, of the Codified Ordinances of the City of Gahanna subject to the requests of the Mifflin Township Fire Department attached hereto as EXHIBIT A.
Section 2. That second reading of this ordinance is hereby waived.
Section 3. That for the reasons set forth in the preamble hereinabove, this ordinance is deemed emergency legislation and shall be in full force and effect after passage by this Council and on date of signature approval by the Mayor.
