TO AUTHORIZE THE MAYOR TO ENTER INTO AMENDMENT TO BARGAINING AGREEMENT BETWEEN THE CITY OF GAHANNA AND THE FRATERNAL ORDER OF POLICE, CAPITAL CITY LODGE, #9; ARTICLE 24, SECTIONS 24.6 THROUGH 24.8, SICK AND INJURY LEAVE; AND TO DECLARE AN EMERGENCY.

WHEREAS, ORD-0165-2010 authorized the negotiated labor agreement between the City of Gahanna and the FOP, and contained language that Sections 24.6 to 24.8 were subject to ongoing bargaining and possibly third party dispute resolution; and
WHEREAS, the City entered into the dispute resolution process and the City and the FOP agreed to submit all other portions of Article 24 for ratification and approval and to submit only these sections to dispute resolution; and
WHEREAS, the dispute resolution process has been completed and the amendment reduces Injury Leave from nine to six months and also allows the City to utilize injured officers in other capacities beside the police department after certain stipulations are met; and
WHEREAS, it is imperative to move forward with the signing of the Amendment to Signing Agreement so that the FOP Agreement can be complete and the new Sick and Injury Leave policy can go into effect, and all for the preservation of the public peace, property, health, safety and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That the Mayor is hereby authorized to enter into AMENDMENT TO BARGAINING AGREEMENT, EFFECTIVE JANUARY 1, 2010 TO DECEMBER 31, 2012 BETWEEN THE CITY OF GAHANNA AND FRATERNAL ORDER OF POLICE, CAPITAL CITY LODGE, #9, ARTICLE 24, SICK AND INJURY LEAVE, Sections 24.6 through 24.8; Amendment attached as EXHIBIT A, and made a part herein.
Section 2. That ORD-0088-2007, passed May 7, 2007, pertaining to Sick and Injury Leave, Sections 24.6 through 24.8 and any ordinances or parts of ordinances in conflict herewith, are hereby repealed.
