TO ACCEPT THE DEED FROM THE FOXBORO RECREATION ASSOCIATION FOR FOXBORO PARK LAND AND TO DEDICATE A TWENTY-FOOT PEDESTRIAN WALKWAY TO PUBLIC USE; AND TO DECLARE AN EMERGENCY.

WHEREAS, the City has agreed to accept the said parcel of land in exchange for reconstruction of the walkway by Ordinance No. 238-97; and
WHEREAS, the walkway has been open to the public for pedestrian access for more than twenty years, and it is prudent to move forward with a dedication for this pedestrian walk way for the preservation of the public peace, health, safety, and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That the plat titled, "Foxboro Walkway," as shown on attached EXHIBIT A, and further described in attached EXHIBIT B, is hereby accepted and named as FOXBORO WALKWAY. That both EXHIBIT A and EXHIBIT B are made a part of this ordinance.
Section 2. That all or parts of the pedestrian walk way easement shown herein and not heretofore dedicated to public use, be and the same is hereby dedicated to public use as such is shown upon recording of said plat.
Section 3. That, for the reasons set forth in the preamble herein above, this ordinance is declared emergency legislation, and shall be in full force and effect immediately upon passage by this Council and approval by the Mayor.
