TO AUTHORIZE THE MAYOR TO EXECUTE THE FIRST AMENDMENT TO THE OPTICAL FIBER USE AGREEMENT WITH THE COMMUNITY IMPROVEMENT CORPORATION OF GAHANNA (CIC); AND TO DECLARE AN EMERGENCY.

WHEREAS, the City of Gahanna has an existing optical Fiber System throughout Gahanna; and
WHEREAS, CIC was granted use of fiber through the Gahanna/New Albany combined fiber network by ORD-0077-2010; and
WHEREAS, the City is willing to enter into an amended agreement with CIC providing more fibers to CIC among other things; and
WHEREAS, it is imperative to move forward immediately to facilitate business in the City, and all for the preservation of the public peace, property, health, safety and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, COUNTY OF FRANKLIN, STATE OF OHIO:
Section 1. That the Mayor is hereby authorized to execute the first amendment to the OPTICAL FIBER USE AGREEMENT, with the COMMUNITY IMPROVEMENT CORPORATION OF GAHANNA; said Agreement attached hereto as EXHIBIT A, and made a part herein.
Section 2. That, for the reasons set forth in the preambles hereto and incorporated herein by this reference, this ordinance is declared emergency legislation and will be in full force and effect upon passage by Council and the signature of approval by the Mayor.
