ORDINANCE AUTHORIZING THE MAYOR TO TERMINATE AN INDEFEASIBLE RIGHT TO USE AGREEMENT WITH FRANKLIN PEAK LLC.

 

BODY

WHEREAS, on October 16, 2017, Council adopted ORD - 0068-2017 authorizing an indefeasible right to use with Franklin Peak, LLC., to provide access to two fiber optic cables from their new building at 781 Science Blvd. to CeraNet at 820 Morrison Road; and,

 

WHEREAS, CeraNet is not able to provide the service needed by Franklin Peak, LLC.; and,

 

WHEREAS, Franklin Peak, LLC., has requested the IRU be terminated,

 

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, COUNTY OF FRANKLIN, STATE OF OHIO:

 

Section 1. That the Mayor is hereby authorized to terminate an Indefeasible Right to Use Agreement with Franklin Peak, LLC., enacted by ORD- 068-2017.

 

Section 2.  That this Ordinance shall be in full force and effect upon passage by Council and 30 days after the signature of approval by the Mayor.
