ORDINANCE NO. 4-98
Title
TO AUTHORIZE THE MAYOR TO ENTER INTO "PCS SITE AGREEMENT" WITH SPRINTCOM, INC., AND TO DECLARE AN EMERGENCY
Body
WHEREAS, SprintCom, Inc., has made proposal to the City to locate a tower at the City Service Complex near Friendship Park; and
WHEREAS, as a part of this Agreement, SprintCom, Inc., commits to construct a road and bridge from the service complex to Lincoln Circle; and
WHEREAS, this proposal comes to City Council with recommendation for approval by the Administration; and
WHEREAS, due to other construction pending in the general area of Olde Gahanna this year, it is desirable to move forward at the earliest possible date to execute this agreement, all for the preservation of the public peace, health, safety, and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That the Mayor is hereby authorized to enter into "PCS SITE AGREEMENT" with SPRINTCOM, INC., 2330 Shawnee Mission Parkway, Westwood, Kansas 66205, Attn: Corporate Secretary, to least a portion of the premises of the Oklahoma Avenue Service Complex for the purpose of installing and constructing transmission and receiving and related facilities, said agreement attached to this ordinance as EXHIBIT A.
Section 2. That, for the reasons set forth in the preamble hereinabove, this ordinance is declared emergency legislation and shall be in full force and effect immediately upon passage by this Council and approval by the Mayor.
