TITLE
AN ORDINANCE AMENDING THE CITY OF GAHANNA CODIFIED ORDINANCES SECTION 133.08 REGARDING COPY CHARGES TO AUTHORIZE FEES FOR THE PRODUCTION OF LAW ENFORCEMENT VIDEO RECORDS CONSISTENT WITH OHIO REVISED CODE SECTION 149.43
BODY
WHEREAS, the Ohio General Assembly recently amended Section 149.43 of the Ohio Revised Code to authorize law enforcement agencies and prosecutor offices to charge certain costs associated with the production of law enforcement video records; and
WHEREAS, the amended statute permits the recovery of costs associated with staff time required to retrieve, download, review, redact, and produce law enforcement video records, subject to the statutory exemptions contained in Ohio Revised Code Section 149.43; and
WHEREAS, the City of Gahanna desires to amend its Copy Charges code to authorize the implementation of fees for the production of law enforcement video records in accordance with state law; and
WHEREAS, these amendments will enable the City's Records Commission to establish and administer a policy governing such charges, including the application of all exemptions required by Ohio Revised Code Section 149.43.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, COUNTY OF FRANKLIN, STATE OF OHIO:
Section 1. That the City of Gahanna Codified Ordinances relating to Section 133.08 - Copy Charges are hereby amended as set forth in EXHIBIT A, attached hereto and incorporated herein by reference.
Section 2. That this Ordinance shall be in full force and effect after passage by this Council and 30 days after signature of approval by the Mayor.
