TO AUTHORIZE THE MAYOR TO ENTER INTO AGREEMENT WITH HOCKADEN & ASSOCIATES, INC., FOR RIGHT OF WAY ACQUISITION ON TAYLOR STATION ROAD AT CLAYCRAFT, IMP. NO. 775; AND TO DECLARE AN EMERGENCY.

WHEREAS, in accordance with plans for Taylor Station Road at Claycraft, it is necessary to obtain rights of way; and

 

WHEREAS, proposals have been received and the proposal from Hockaden & Associates, Inc. has been recommended by the City Engineer; and

 

WHEREAS, it is necessary to proceed at the earliest possible date with this acquisition in order to maintain the established time table for this important project, all for the preservation of the public peace, health, safety, and welfare;

 

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:

 

Section 1.  That the Mayor is hereby authorized to enter into agreement with HOCKADEN & ASSOCIATES, INC., 883 North Cassady Avenue, Columbus, OH  43219, for right of way acquisition for Taylor Station Road at Claycraft, Imp. No. 775, including title research, closings, instrument recording, appraisal, and negotiations, all in accordance with proposal submitted August 6, 2002, attached hereto as EXHIBIT A, and in accordance with City Specifications.

 

Section 2.  That the amount of THIRTEEN THOUSAND THREE HUNDRED SEVENTY FIVE DOLLARS ($13,375) is hereby supplementally appropriated from the unencumbered, unappropriated balance in the General Fund to Account No. 101.145.5533, Capital Projects, Engineering, to cover the herein costs.

 

Section 3.  That ORD-0001-2002, passed January 2, 2002, is hereby amended to reflect this supplemental appropriation.

 

Section 4.  That, for the reasons set forth in the preamble herein above, this ordinance is declared emergency legislation and shall be in full force and effect immediately upon passage by this Council and on date of signature approval by the Mayor.
