TO AMEND ORD-0050-2003 TO ALLOW FOR THE CORRECTION OF THE DEDICATED STREETS CONTAINED IN THE ORDINANCE ACCEPTING THE FINAL PLAT FOR FOXWOOD SECTION 1; AND TO DECLARE AN EMERGENCY.

WHEREAS, ORD-0050-2003 accepted the final plat for property known as Foxwood, Section 1; and
WHEREAS, the name of one street listed in the ordinance as being dedicated to public use already exists in the City of Gahanna; and
WHEREAS, the streets listed on the plat for Foxwood, Section 1 need to be approved and accepted; and
WHEREAS, this error went unnoticed and the plat was approved and now needs corrected and it is prime building season and therefore prudent to allow the developer to move forward as soon as possible, all in consideration of the public peace, health, safety and welfare:
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That adoption of the Final Plat for Foxwood, Section 1, as passed by ORD-0050-2003 is hereby reaffirmed with the following amendment:
That the streets listed in ORD-0050-2003 as Foxwood Drive, Preservation Lane and Taylor Road, be corrected to Kason's Way, Preservation Lane and Taylor Road.
Section 2. That the above streets not heretofore dedicated to public use, be and the same are hereby accepted and confirmed, subject to all requirements as set out in Chapter 1107, 1109, 1193 and 1195 of the Codified Ordinances of Gahanna, Ohio.
Section 3. That the final plat as approved by ORD-0050-2003 and reaffirmed by this legislation is hereby attached as EXHIBIT A.
Section 4. That, for the reasons stated in the preamble hereinabove, this ordinance is declared emergency legislation, and shall be in full force and effect after passage by this Council and upon date of signature approval by the Mayor.
