TO AMEND SECTION 519.99, PENALTIES, OF CHAPTER 519, SMOKING PROHIBITIONS OF THE CODIFIED ORDINANCES OF THE CITY OF GAHANNA

WHEREAS, the voters of the City of the Gahanna passed a ballot initiative creating a code chapter banning smoking in public places; and
WHEREAS, a provision in the Penalties section of the legislation approved by voters is inconsistent with provisions of state law relating to allocation of costs; and
WHEREAS, the City is required to send certain costs collected as part of any fines and costs levied in a court action to the state; and
WHEREAS, it is prudent for the City of Gahanna to amend the code before enforcement begins on February 21, 2006;
NOW, THEREFORE, BE IT ORDAINED, BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That Section 519.99, Penalties, of Chapter 519, Smoking Prohibitions, is hereby amended as shown in EXHIBIT A attached hereto.
Section 2. That any ordinance or ordinances in conflict hereto are hereby repealed.
Section 3. That this ordinance shall be in full force and effect after passage by this Council and 30 days after signature of approval by the Mayor.
