WHEREAS, pursuant to Ohio Revised Code, Section 120.14(E), the City may authorize the Franklin County Municipal Court to represent indigent persons before the Franklin County Municipal Court charged under Gahanna ordinances; and
 
WHEREAS, it is imperative to move forward with this contract as the existing contract with Franklin County Public Defender expired January 1, 2014, and all for the preservation of the public peace, property, health, safety and welfare;
 
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
 
Section 1.  That the Mayor is hereby authorized to enter into contract with Franklin County Public Defender Commission for the representation of indigent persons coming before the Franklin County Municipal Court, Criminal Division, charged with a violation of an ordinance of the City of Gahanna; said Contract attached as EXHIBIT A, and made a part herein.
 
Section 2.  That the Contract is effective retroactive to January 1, 2014.
 
Section 3. That funding in the amount of SIX THOUSAND DOLLARS ($6,000) was set aside in the 2014 Appropriations to Account No. 101.151.5240, Mayor's Court, Counsel - Indigent, to cover the herein costs.
 
Section 4.  That, for the reasons set forth in the preamble hereinabove, this ordinance is declared emergency legislation and shall be in full force and effect immediately upon passage by this Council and on date of signature approval by the Mayor.
