TO AMEND CHAPTER 941, GARBAGE AND RUBBISH COLLECTION, OF THE CODIFIED ORDINANCES OF THE CITY OF GAHANNA, TO AMEND SECTION 941.02, GARBAGE, RUBBISH RECEPTACLES REQUIRED; SECTION 941.12, FAILURE TO COMPLY; REMEDY; SECTION 941.15, PICKUP AND DISPOSAL FEES; SECTION 941.16, PAYMENT SCHEDULE; SECTION 941.17, PARTIAL PAYMENT; AND SECTION 941.99, PENALTY; AND TO DECLARE AN EMERGENCY.

WHEREAS, after extensive review of Chapter 941 the following amendments are recommended by the Director of Public Service; and
WHEREAS, it is imperative to move forward with these changes so they can be in place for January 2004, all for the preservation of the public peace, health, safety and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That Chapter 941, Garbage and Rubbish Collection, is hereby amended as set forth in EXHIBIT A, attached hereto and made a part herein.
Section 2. That existing Chapter 941, Garbage and Rubbish Collection, or any ordinances or parts of ordinances in conflict herewith, are hereby repealed.
Section 3. That, for the reasons set forth in the preamble herein above, this ordinance is declared emergency legislation and shall be in full force and effect immediately after passage by this Council and on date of signature approval by the Mayor.
