TO AUTHORIZE THE MAYOR TO ENTER INTO REIMBURSEMENT AGREEMENT WITH CANINI AND PELLECCHIA, INC., FOR CONSTRUCTION OF PHASE ONE OF THE TRIANGLE NORTH SANITARY SEWER, PHASE I, IMPROVEMENT NO. 696; AND TO DECLARE AN EMERGENCY

WHEREAS, the sanitary sewer construction is an integral part of the development of the Triangle North; and
WHEREAS, the developer is now ready to move forward with this portion of the project and it is desirable to enter into Agreement in order that the developer can be properly reimbursed for this project, which will be mutually beneficial, all for the preservation of the public peace, health, safety, and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That the Mayor is hereby authorized to enter into Agreement with Canini and Pellecchia, Inc., for the purpose of constructing the Sanitary North Sanitary Sewer, Improvement No. 696, for an amount not to exceed Three Hundred Thousand Dollars ($300,000), which was set aside in the 1998 Appropriations to Account No. 661.360.5533, Capital Projects, Sewer.
Section 2. That Agreement authorized herein is attached to this ordinance as EXHIBIT A.
Section 3. That, for the reasons set forth in the preamble hereinabove, this ordinance is declared emergency legislation and shall be in full force and effect immediately upon passage by this Council and approval by the Mayor.
