TO AUTHORIZE THE MAYOR TO ENTER INTO SIDEWALK DINING LEASE WITH AREPAZO GAHANNA LLC DBA/AREPAZO TAPAS & WINE, TO ALLOW SIDEWALK DINING IN THE RIGHT OF WAY AT 93 NORTH HIGH STREET, GAHANNA; AND TO DECLARE AN EMERGENCY.

WHEREAS, ORD-0084-2012 enacted code allowing sidewalk dining and non-permanent amenities to be installed in the right of way; and
WHEREAS, the outdoor dining season is upon us and Arepazo Tapas & Wine has completed the lease application and paid the necessary fee; and
WHEREAS, the Director of Public Service has recommended we enter into Sidewalk Dining Lease with Arepazo Gahanna LLC dba/Arepazo Tapas & Wine; and
WHEREAS, Arepazo Tapas & Wine would like to begin outside service as soon as possible and all for the preservation of the public peace, property, health, safety and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That the Mayor is hereby authorized to enter into Sidewalk Dining Lease with Arepazo Gahanna LLC dba/Arepazo Tapas & Wine, 93 North High Street, Gahanna, Ohio 43230; Lease attached as EXHIBIT A, and made a part herein.
Section 2. That, for the reasons set forth in the preamble herein above, this ordinance is declared emergency legislation and shall be in full force and effect immediately upon passage by this Council and on date of signature approval by the Mayor.
