TITLE

AN ORDINANCE AUTHORIZING THE MAYOR TO ENTER INTO AN EASEMENT AGREEMENT WITH COLUMBIA GAS OF OHIO, INC., TO PROVIDE NATURAL GAS SERVICE TO THE CELL TOWER LOCATED AT LOWER MCCORKLE PARK

BODY

WHEREAS, the existing cell tower located at Lower McCorkle Park, Franklin County Parcel No. 025-004341, requires a natural gas service line to operate an emergency generator at the facility; and

 

WHEREAS, Columbia Gas of Ohio, Inc., has requested a ten-foot (10’) easement along the existing service road accessing the cell tower to install and maintain a natural gas service line; and

 

WHEREAS, the proposed easement area runs parallel to an existing American Electric Power (AEP) easement, and the Administration has reviewed the request and determined it to be necessary and appropriate for continued utility service and public safety; and

 

WHEREAS, the Administration recommends acceptance of the easement agreement to authorize Columbia Gas of Ohio, Inc., to construct, operate, and maintain the necessary gas line within said easement; and

 

WHEREAS, upon approval, the executed easement shall be recorded with the Franklin County Recorder’s Office.

 

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, COUNTY OF FRANKLIN, STATE OF OHIO, THAT:

 

Section 1. The Mayor is hereby authorized to enter into and execute an Easement Agreement with Columbia Gas of Ohio, Inc., primary offices located at 290 West Nationwide Boulevard, Columbus, Ohio 43215, granting a ten-foot (10’) permanent easement across a portion of City-owned property known as Lower McCorkle Park (Franklin County Parcel No. 025-004341); said Easement Agreement is attached hereto and incorporated herein as EXHIBIT A.

 

Section 2. This Ordinance shall be in full force and effect after passage by this Council and 30 days after signature of approval by the Mayor.
