Title

TO ACCEPT DEEDS OF EASEMENT FROM FIVE PROPERTY OWNERS FOR PROPERTY LOCATED ALONG JOHNSTOWN ROAD (U.S. ROUTE 62), FOR IMPROVEMENT KNOWN AS THE TRIANGLE NORTH SANITARY SEWER, IMPROVEMENT NO. 696; AND TO DECLARE AN EMERGENCY

Body

WHEREAS, certain Deeds of Easement were granted to the City of Gahanna for the purpose of constructing, using and maintaining a Triangle North Sanitary Sewer, Improvement No. 696, and appurtenances thereto, including the right to clean, repair, and care for said improvement, together with the right of access to said easement for said purposes; and

 

WHEREAS, it is necessary for this Council to accept this land at the earliest possible date in order to proceed with those steps necessary to provide this Improvement No. 696, all for the preservation of the public peace, health, safety, and welfare;

 

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:

 

Section 1.  That this Council hereby accepts Deeds of Easement for the Triangle North Sanitary Sewer, Improvement No. 696, from the following property owners along Johnstown Road (U.S. Route 62):

 

EXHIBIT A:  Deed of Easement from James M. Ryan, consisting of 0.064 acre, more or less.

 

EXHIBIT B:  Deed of Easement from James M. Ryan, Trustee of the James M. Ryan Family Trusts I, II, III, IV, and V, consisting of 0.024 acre, more or less.

 

EXHIBIT C:  Deed of Easement from Gary E. and Jeanne M. Green, consisting of 0.047 acre, more or less.

 

EXHIBIT D:  Deed of Easement from Brent and Carol Hall, consisting of 0.055 acre, more or less.

 

EXHIBIT E:  Deed of Easement from Robert J. and Loretta McWhorter, consisting of 0.052 acre, more less.

 

 

Section 2.  That, for the reasons set forth in the preamble herein above, this ordinance is declared emergency legislation and shall be in full force and effect immediately upon passage by this Council and on date of signature approval by the Mayor.
