TO AMEND CODE SECTION 513.12, DRUG PARAPHERNALIA, AND TO ENACT CODE SECTION 513.121, MARIHUANA DRUG PARAPHERNALIA, OF CHAPTER 513, DRUG ABUSE CONTROL, OF THE CODIFIED ORDINANCES OF THE CITY OF GAHANNA; AND TO DECLARE AN EMERGENCY.

WHEREAS, the City Attorney has recommended a change to Section 513.12, Drug Paraphernalia and the enactment of new Section 513.121 due to recent state law changes that are in effect as of September 28, 2012; and
WHEREAS, it is the desire of the Police Department to begin citing under this revised and new section of code; and
WHEREAS, in order to cite immediately the City Attorney has requested a waiver and emergency, all for the preservation of the public peace, property, health, safety and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That Code Section 513.12, Drug Paraphernalia, of Chapter 513, Drug Abuse Control, is hereby amended as set forth in EXHIBIT A, attached hereto and made a part herein.
Section 2. That Code Section 513.121, Marihuana Drug Paraphernalia, of Chapter 513, Drug Abuse Control, is hereby enacted as set forth in EXHIBIT A, attached hereto and made a part herein.
Section 3. That existing Section 513.12, Drug Paraphernalia, of Chapter 513, Drug Abuse Control, or any ordinances or parts of ordinances in conflict herewith, are hereby repealed.
Section 4. That, for the reasons set forth in the preamble hereinabove, this ordinance is declared emergency legislation and shall be in full force and effect after passage by this Council and on date of signature approval by the Mayor.
