TO AUTHORIZE THE MAYOR TO ENTER INTO AGREEMENT WITH R. D. ZANDE & ASSOCIATES, INC., FOR RIGHT OF WAY ACQUISITION ON HAMILTON ROAD, CLARK AVENUE, AND OKLAHOMA AVENUE; AND TO DECLARE AN EMERGENCY.

WHEREAS, plans have been reviewed for the improvement of Clark Avenue and Oklahoma Avenue, and for the appraisals for the acquisition of two total takes on Hamilton Road; and

 

WHEREAS, it is necessary to obtain certain rights of way; and

 

WHEREAS, cost proposal has been received under date of January 25, 2000, and has been recommended by the City Engineer; and

 

WHEREAS, it is necessary to proceed at the earliest possible date with this acquisition in order to maintain the established time table for these important projects, all for the preservation of the public peace, health, safety, and welfare;

 

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:

 

Section 1.  That the Mayor is hereby authorized to enter into agreement with R. D. ZANDE & ASSOCIATES, INC., 1237 Dublin Road, Columbus, Ohio, 43215, for right of way acquisition Hamilton Road, Clark Avenue, and Oklahoma Avenue, including title research, closings, instrument recording, appraisal, negotiations, and Low Value Analysis forms for twenty-seven parcels of real estate, all in accordance with City specifications, and in accordance with cost proposal submitted January 25, 2000, attached hereto as EXHIBIT A, and made a part herein.

 

Section 2.  That the amount of Thirty-two Thousand Two Hundred Fifty Dollars ($32,250) was set aside to Account No. 101.145.5541, Capital Projects, Streets, in the Year 2000 Appropriations to cover the herein costs.

 

Section 3.  That, for the reasons set forth in the preamble herein above, this ordinance is declared emergency legislation and shall be in full force and effect immediately after passage by this Council and date of signature approval by the Mayor.
