TO ACCEPT THE FINAL PLAT ENTITLED DEDICATION OF BEECHER ROAD AND EASEMENTS; AND TO DECLARE AN EMERGENCY.
Body

WHEREAS, development between U. S. 62 and Hamilton Road has enabled a newly-constructed road, and it is desirable to complete a small portion of this road for a thorough dedication to public use; and

WHEREAS, due to pending signalization and other intersection considerations, it is important to move along with this road dedication at the earliest possible date, all for the orderly flow of vehicular traffic and for the preservation of the public peace, health, safety, and welfare;

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:

Section 1. That the plat titled "Dedication of Beecher Road," as shown on attached EXHIBIT A, and further described in attached EXHIBIT B, is hereby accepted and named as BEECHER ROAD. That both EXHIBIT A and EXHIBIT B are made a part of this ordinance.

Section 2. That all or parts of the road shown herein and not heretofore dedicated to public use, be and same is hereby dedicated to public use as such upon recording of said plat.

Section 3. That easements so indicated on the "Dedication of Beecher Road" Plat are hereby reserved for the construction, operation, and maintenance of all public utilities, above and beneath the surface of the ground, and where necessary, are for the construction, operation, and maintenance of service connections to all adjacent lots and lands and for storm water drainage. Such maintenance shall include the right to remove any branches, growths, or construction that interfere with said construction, safe operation and maintenance of said utilities or drainage facilities, and that said maintenance shall be responsible only for restoration of said easement areas only to the contour or grade existing at the time said maintenance operations begin.
