TITLE
AN ORDINANCE TO ACCEPT THE ANNEXATION OF APPROXIMATELY 7.6 ACRES FROM JEFFERSON TOWNSHIP, FRANKLIN COUNTY, OHIO, TO THE CITY OF GAHANNA; LOCATED AT 4736 AND 4722 JOHNSTOWN ROAD (PARCEL ID NOS. 170-000068 AND 170-000069).
BODY

WHEREAS, Jimmie Toney and Darlene Toney, owners of approximately 7.6 acres of real property located at 4736 and 4722 Johnstown Road in Jefferson Township, Franklin County, Ohio, identified as Franklin County Parcel Identification Numbers 170-000068 and 170-000069 (the "Property"), filed an Expedited Type II annexation petition with the Franklin County Board of Commissioners pursuant to Ohio Revised Code Chapter 709; and

WHEREAS, City Council authorized the Mayor to enter into a pre-annexation agreement with Jimmie Toney, Darlene Toney, and Trivium Development, LLC, by Ordinance 0021-2025, identifying potential development considerations for the Property; and

WHEREAS, pursuant to Ohio Revised Code Section 709.023(C), City Council adopted Resolution 0052-2025 on November 3, 2025, setting forth the municipal services to be provided to the territory proposed for annexation and the approximate date by which such services would be provided; and

WHEREAS, on December 2, 2025, the Franklin County Board of Commissioners approved the annexation petition, also known as Case Number ANX-40-25, by Resolution No. 0911-25 in accordance with law; and

WHEREAS, the Clerk of Council received a certified copy of the Franklin County Board of Commissioners' resolution on December 12, 2025, thereby commencing the sixty (60) day wait period for City Council consideration pursuant to Ohio Revised Code Section 709.04; and

WHEREAS, City Council has reviewed the petition and supporting materials and finds that the annexation is in the best interest of the City of Gahanna.

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, COUNTY OF FRANKLIN, STATE OF OHIO:
