TO AMEND CHAPTER 721, CANVASSING AND SOLICITATION, OF THE CODIFIED ORDINANCES OF GAHANNA, TO INCREASE PENALTY FOR INTRASTATE COMMERCE; PEDDLERS.

WHEREAS, problems continue for the Mayor's Court to collect penalties from out of state violators; and

 

WHEREAS, it is desirable to increase the penalties in order that bond must be posted, which would give the court a means of monetary collection from such violators;

 

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:

 

Section 1.  That Section 721.99, Penalty, of Chapter 721, Canvassing and Solicitation, of the Codified Ordinances of Gahanna, is hereby amended to increase penalties for violators of the Intrastate Commerce Laws as follows:

 

721.99  PENALTY.

(a)  Whoever violates any provision of this chapter for which no penalty is otherwise provided is guilty of a minor misdemeanor.

 

(b)  Whoever violates Section 721.05(f) is guilty of a misdemeanor of the fourth degree.

 

(c)  Whoever violates Section 721.06(a) is guilty of a MISDEMEANOR OF THE FOURTH DEGREE for the first offense and a misdemeanor of the THIRD degree for any subsequent offense.

 

 

Section 2.  That existing Section 721.99, Penalty, or any ordinances of parts of ordinances in conflict herewith are hereby repealed.

 

Section 3.  That this ordinance shall be in full force and effect after passage by this Council on the thirtieth day following the date of the signature approval by the Mayor.
