TO AUTHORIZE THE DIRECTOR OF PUBLIC SERVICE TO AWARD AND THE MAYOR TO ENTER INTO CONTRACT WITH MJ EXCAVATING SERVICES, INC.,
FOR THE CHERRYBOTTOM ROAD WATERLINE; AND TO DECLARE AN EMERGENCY.

WHEREAS, bids were accepted for the Cherrybottom Road Waterline on December 4, 2000; and
WHEREAS, the lowest and best bidder has been selected by the Director of Public Service with concurrence of the City Engineer; and
WHEREAS, it is imperative to move forward with this project due to construction time remaining this year, all for the preservation of the public peace, health, safety and welfare.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That the Mayor is hereby authorized to enter into contract with MJ EXCAVATING SERVICES INC., for the construction of the Cherrybottom Road Waterline, in accordance with bid and City specifications, bid tab attached as EXHIBIT A.
Section 2. That funding in the amount of FOUR HUNDRED TWO THOUSAND EIGHT HUNDRED FIFTY THREE DOLLARS ($402,853) has been appropriated from the unencumbered, unappropriated balance in Account No. 652.351.5596 to cover herein costs.
Section 3. That for the reasons set forth in the preamble herein above this ordinance is declared emergency legislation and shall be in full force and effect after passage by this Council and on date of signature approval by the Mayor.
