TO AUTHORIZE THE MAYOR TO ENTER INTO AGREEMENT TO PURCHASE A TEMPORARY AND PERMANENT MULTI PURPOSE TRAIL EASEMENT FOR THE BIG WALNUT TRAIL, SECTION 3, FROM THE NOB HILL CIVIC ASSOCIATION; AND TO DECLARE AN EMERGENCY.

WHEREAS, ORD-0091-2011 authorized funds to purchase a temporary and permanent Multi Purpose Trail Easement from the Nob Hill Civic Association for Section 3 of the Big Walnut Trail; and

 

WHEREAS, it is necessary that the Mayor be authorized to enter into said agreement, and the Director of Parks & Recreation is requesting that the Mayor also be authorized to sign any other required documents related to the purchase of said easement; and

 

WHEREAS, it is imperative to move forward with this ordinance to allow for the purchase at the earliest time possible, and all for the preservation of the public, peace, property, health, safety and welfare;

 

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:

 

Section 1.  That The Mayor is hereby authorized to enter into agreement to purchase a Multi Purpose Trail Easement from the Nob Hill Civic Association for Section 3 of the Big Walnut Trail, and that the Mayor is hereby authorized to sign any other required documents related to the purchase of said easement; Multi Purpose Trail Easement attached as EXHIBIT A, and made a part herein.

 

Section 2.  That, for the reasons set forth in the preamble herein above, this ordinance is declared emergency legislation and shall be in full force and effect immediately upon passage by this Council and on date of signature approval by the Mayor.
