TO AUTHORIZE THE MAYOR TO ENTER INTO A DEVELOPMENT AGREEMENT WITH PORTRAIT HOMES LLC FOR SALE OF PROPERTY AND IMPROVEMENTS TO BE MADE FOR DEVELOPMENT OF A CONDOMINIUM PROJECT KNOWN AS GAHANNA GROVE ON EAST JOHNSTOWN ROAD; AND TO DECLARE AN EMERGENCY

WHEREAS, the City of Gahanna wishes to sell property that it owns at 4491 East Johnstown Road, the former Evans property; and

 

WHEREAS, the Development Department has negotiated an Agreement with Portrait Homes which has been reviewed by the City Engineer and the City Attorney and they have recommended to proceed with the Agreement; and

 

WHEREAS, the developer wishes to move forward with this project as quickly as possible and the land contracts will expire shortly so it is imperative to act as quickly as possible, all for the preservation of the public peace, health, safety and welfare;

 

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:

 

Section 1.  That the Mayor is hereby authorized to enter into Agreement with Portrait Homes LLC, for purchase of the property at 4491 East Johnstown Road, formerly the Evans property; said Agreement attached hereto as EXHIBIT A and made a part of this ordinance.

 

Section 2.  That Portrait Homes LLC will pay the City of Gahanna $141,531 for the property and also contribute $200,000 for the improvement of Johnstown Road, including the intersection of Johnstown Road and YMCA Place, the extension of YMCA Place and a sidewalk along Johnstown Road, plus deed to the City a total of 2.8 acres for Parkland Dedication and further dedicate 50 feet of right of way to provide ingress and egress to the Shareef parcel; as outlined in the development agreement and in Section 1109.08 of the code.

 

Section 3.  That this ordinance is declared emergency legislation and shall be in full force and effect after passage by this Council and on date of signature of approval by the Mayor.
