WHEREAS, a roadway project has been negotiated with Brookewood Construction Inc. whereby they will reconstruct the entire McCutcheon Road from Stygler Road east to the entrance to McCorkle Park with the agreement that the City will pay 25% up to $70,000 of the construction costs; and

 

WHEREAS, this road improvement is necessary for access to McCorkle Park; and

 

WHEREAS, due to the impending construction season and the developer's desire to move forward in a timely fashion, it is deemed necessary to appropriate the funds and enter into contract as quickly as possible, all for the preservation of the public peace, health, safety and welfare;

 

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:

 

Section 1.  That the Mayor is authorized to enter into "Reimbursement Agreement for Construction of Street; Woodmere Place, Old McCutcheon Road, Improvement No. 791" with Brookewood Construction, Inc., said agreement attached hereto as EXHIBIT A and made a part herein.

 

Section 2.  That the amount of Seventy Thousand Dollars ($70,000) is hereby supplementally appropriated from the unencumbered, unappropriated balance in the General Fund to Account No. 101.145.5541, Streets, to provide 25% of the actual cost of construction up to $70,000.

 

Section 3.  That, for the reasons set forth in the preamble hereinabove, this ordinance is declared emergency legislation, and shall be in full force and effect after passage by this Council and on date of signature approval by the Mayor.
