TO ACCEPT DEED OF EASEMENT IN THE AREA OF CLARK STATE ROAD FOR ROADWAY AND PUBLIC UTILITY PURPOSES; FROM ELMA S YEARLING.

WHEREAS, an easement for construction of streets and all public utilities above and beneath the surface of the ground was obtained in 1972 from Elma S. Yearling; and
WHEREAS, said roadway and utility easement was recorded on September 5, 1972 by the Franklin County Recorder's Office; and
WHEREAS, said roadway and utility easement was never accepted by the City of Gahanna;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That this Council hereby accepts the Deed of Easement from Elma S. Yearling, for roadway and public utility purposes in the area of Clark State Road, said land more particularly described in EXHIBIT A attached hereto and made a part herein.
Section 2. That this ordinance shall be in full force and effect at the earliest period allowed by law.
