WHEREAS, the Ohio Revised Code Section 1905.05 provides for the appointment by the Mayor of a Magistrate to preside over Mayor's Court; and

 

WHEREAS, with the close scrutiny that has been placed on Mayor's Courts the City Attorney has advised that the Mayor not preside over Mayor's Court; and

 

WHEREAS, the Clerk of Court has asked that the rate of pay per court session be raised to $400 per court session, and City Council agrees;

 

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:

 

Section 1.  That the Mayor is hereby authorized to enter into contract with Donald O. Breckenridge, 3009 Columbus Street, Grove City Ohio, 43123, to serve as Magistrate of the City of Gahanna Mayor's Court; Contract attached as EXHIBIT A.

 

Section 2.  That the rate of pay per court session be established at FOUR HUNDRED DOLLARS ($400) per session, retroactive to July 1, 2000.

 

Section 3.  That the amount of FIVE THOUSAND TWO HUNDRED DOLLARS ($5,200) is hereby supplementally appropriated from the unencumbered, unappropriated balance in the General Fund to Account No. 101.151.5242, Contract Magistrate, to cover the herein costs.

 

Section 4.  That ORD-0001-2000, passed January 3, 2000, is hereby amended to reflect this supplemental appropriation.   

 

Section 5.  That this ordinance shall be in full force and effect immediately upon passage by this Council and approval by the Mayor.
