TO AUTHORIZE THE MAYOR TO NEGOTIATE AND EXECUTE EASEMENT FOR AMERITECH NON EXCLUSIVE EASEMENT FOR TELEPHONE EQUIPMENT ON CITY PROPERTY; 5571 HAVENS CORNERS ROAD; AND TO DECLARE AN EMERGENCY

WHEREAS, Ameritech has requested easement through City property, at 5571 Havens Corners Road; and
WHEREAS, the City Engineer has asked that we move forward to execute this easement; and
WHEREAS, the City held execution of his easement for disucssion on the concerns of exclusive versus non exclusive; and
WHEREAS, Ameritech has agreed to a Non Exclusive Easement and it is in the best interest of the City to move forward as quickly as possible for this work to be completed, all for the preservation of the public peace, health, safety and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That the Mayor is hereby authorized to execute Ameritech Non Exclusive Easement, to allow for telephone equipment on City property, 5571 Havens Corners Road.
Section 2. That for the reasons set forth in the preamble hereinabove, this ordinance is declared emergency legislation and shall be in full force and effect after passage by this Council and on date of signature approval by the Mayor.
