A RESOLUTION APPROVING A TEMPORARY EXPANSION OF OUTDOOR SEATING INTO CITY-OWNED LAND FOR STADIUM R, LLC.

WHEREAS, Governor Mike DeWine has issued Executive Order 2020-01D, declaring a State of Emergency in the State of Ohio as a necessary statewide preventive and proactive measure to slow the spread of COVID-19;
WHEREAS, the Director of the Ohio Department of Health has issued multiple statewide Orders relative to COVID-19, including Orders that have limited the operation of restaurants and dining establishments under the State of Ohio's Responsible RestartOhio Sector Specific Operating Requirements; and
WHEREAS, the State of Ohio has ordered that existing restaurants and dining establishments may temporarily expand outdoor seating areas to accommodate social distancing requirements, provided that approval for the proposed expansion is given by the local legislative authority and local public health department; and
WHEREAS, under the State of Ohio's Order, any temporary expansion of an outdoor seating area will cease immediately upon termination of the State of Ohio's Responsible RestartOhio Sector Specific Operating Requirements for restaurants, or as otherwise mandated by the legislative authority; and
WHEREAS, Stadium R, LLC, a dining establishment located in the Creekside Development, has requested approval from the City of Gahanna to temporarily expand its outdoor seating area into city-owned land.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF GAHANNA, COUNTY OF FRANKLIN, STATE OF OHIO:
Section 1. The City Council grants approval to Stadium R, LLC to temporarily expand its outdoor seating, in an area and manner to determined and approved by the City of Gahanna's Planning & Zoning Administrator, with such temporary expansion to immediately cease upon termination of the State of Ohio's Responsible RestartOhio Specific Operating Requirements for restaurants or unless otherwise mandated by Gahanna City Council.
