A RESOLUTION AUTHORIZING THE CITY ATTORNEY TO ENTER INTO THE SIX REMNANT DEFENDANTS SETTLEMENT.
BODY

A RESOLUTION AUTHORIZING the City Attorney to execute the Participation Form for the Six Remnant Defendants, a new national opioid settlement subject to OneOhio.

WHEREAS, the State of Ohio has developed the OneOhio plan, a mechanism to ensure that money from negotiated settlements with distributors of opioids is distributed fairly to communities hit hardest by the opioid crisis; and;

WHEREAS, the settlement agreement allocates 30 percent to local governments, 55 percent to a foundation that will distribute funds to projects, and 15 percent to the Office of the Ohio Attorney General as Counsel for the State of Ohio; and

WHEREAS, the Gahanna City Council passed RES-0028-2021 on August 9, 2021, to accept the material terms of the OneOhio settlement pursuant to the Memorandum of Understanding and consistent with the terms of the July 21, 2021, National Opioid Settlement agreement; and

WHEREAS, there is a new national opioid settlement with Associated Pharmacies, Inc. (and American Associated Pharmacies); J M Smith Corporation; Louisiana Wholesale Drug Company, Inc.; Morris and Dickson Co.; North Carolina Mutual Wholesale Drug Company, Inc.; and United Natural Foods, Inc. (including its subsidiaries SuperValu and Advantage Logistics) ("Six Remnant Defendants Settlement") which requires the execution of a Participation Form in order to receive our eligible allocation of funds; and

WHEREAS, this City Council wishes to participate in the Six Remnant Defendants Settlement and receive the eligible funds.

NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF GAHANNA, COUNTY OF FRANKLIN, STATE OF OHIO:

Section 1. That this City Council hereby authorizes the City Attorney to participate in the Six Remnant Defendants Settlement and to execute any documentation necessary to effectuate this Resolution.
