WHEREAS, the City Engineer, on September 21, 2012 filed with the Clerk of Council plans, specifications, profiles and a cost estimate for the construction of the Triangle East Sanitary Sewer, Imp. No. SA-871, Phase 1, said filing in accordance with Section 727.12 of the Ohio Revised Code and pursuant to Council request by SR-0001-2012; and

WHEREAS, the extension of this sanitary sewer line is mandated immediately for the preservation of the public peace, property, health, safety and welfare;

NOW, THEREFORE, BE IT RESOLVED THE COUNCIL OF THE CITY OF GAHANNA, COUNTY OF FRANKLIN, STATE OF OHIO:

Section 1. It is hereby determined to be necessary to construct an extension of the Triangle East Sanitary Sewer, Imp. No. SA-871, Phase 1, to properties known as 4550, 4560, 4570 and 4580 East Johnstown Road, as such dedication is recorded in the Recorder's Office of Franklin County, Ohio, whereby said lots lie along East Johnstown Road.

Section 2. It is hereby determined and declared that this improvement is conducive to the public health, convenience and welfare of the City and inhabitants thereof.

Section 3. That plan of the improvement after the improvement has been completed shall be as shown on the Engineer's plan, which are on file in the office of the Clerk of Council and available for public inspection, and are incorporated therein by reference and made a part thereof.

Section 4. The cost of the assessment shall be calculated herein as thirty-three thousand six hundred twenty eight dollars ($33,628) and shall be assessed upon 4550, 4560, 4570 and 4580 East Johnstown Road at an equal amount of eight thousand four hundred seven dollars ($8,407) to each property, which are hereby determined to be specifically benefited by the improvement.
