WHEREAS, easement is needed to pass through the property at 496 East Johnstown Road to reach two properties in need of sewer, at 510 and 522 East Johnstown Road for the Larry Lane Sanitary Sewer Extension; and
WHEREAS, future statutory resolutions will be needed to move forward with this project;
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That this Council hereby declares the necessity and intent to appropriate a certain parcel of real estate for sanitary sewer easement; by the City of Gahanna for the Larry Lane Sanitary Sewer Extension, Improvement No. SA 1013; property owned by the Ellen LePera Trust; 496 East Johnstown Road; pursuant to and in accordance with the Codified Ordinances of the City of Gahanna, the Charter of the City of Gahanna, and the Constitution of the State of Ohio, Chapter 719 and Chapter 163, Ohio Revised Code; said parcel more particularly described in EXHIBIT A, attached hereto and made a part herein.
Section 2. That the City Attorney or his representative is hereby authorized and directed to cause a written notice of the adoption of this Resolution to be given to the owner/s/, person/s/, in possession of and person/s/ having a real or possible interest or record in the premises described in EXHIBIT A, herein, and said notice shall be served by said City Attorney or his representative, who shall make return of said service of notice in the manner provided by law.
Section 3. That this statutory resolution shall be in full force and effect after passage by this Council and 30 days after date of signature approval by the Mayor.
