TO AUTHORIZE THE MAYOR TO ENTER INTO CONTRACT MODIFICATION WITH CRAIG B. PAYNTER, ATTORNEY WITH CHESTER, WILLCOX & SAXBE, LLP, TO INCREASE THE SCOPE OF WORK FOR LEGAL SERVICES IN CONNECTION WITH THE HAMILTON/GRANVILLE INTERSECTION PROJECT; IMPROVEMENT NO. 883; TO SUPPLEMENTALLY APPROPRIATE $75,000; AND TO DECLARE AN EMERGENCY.

WHEREAS, ORD-0038-2010 authorized the contract for right of way legal services for the Hamilton/Granville intersection; and
WHEREAS, ORD-0120-2010 authorized a contract modification for increased legal work for this improvement; and
WHEREAS, negotiations are ongoing with Englefield Oil on right of way acquisition which may result in extensive legal involvement; and
WHEREAS, it is necessary to appropriate funds in order to have them available if the additional work is needed, and all for the preservation of the public peace, property, health, safety and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That the Mayor is hereby authorized to enter into modified contract with CRAIG B. PAYNTER, of Chester, Willcox & Saxbe, 65 East State Street, Suite 1000, Columbus, Ohio 43215, to increase the scope of work to cover additional legal services for right of way acquisition; proposal attached as EXHIBIT A.
Section 2. That funding in the amount of SEVENTY FIVE THOUSAND DOLLARS ($75,000) is hereby supplementally appropriated from the unencumbered, unappropriated balance of the Capital Improvement Fund to Account No. 325.122.5513, Capital Projects/Streets, to cover the herein costs.
Section 3. That ORD-0001-2011, passed January 3, 201`, is hereby amended to reflect this supplemental appropriation.
Section 4. That, for the reasons set forth in the preamble hereinabove, this ordinance is declared emergency legislation and shall be in full force and effect immediately upon passage by this Council and on date of signature approval by ...
