TO AUTHORIZE THE MAYOR TO ENTER INTO SETTLEMENT WITH MCDONALD'S USA, LLC, FOR PROPERTY AT 110 NORTH HAMILTON ROAD, FOR TEMPORARY RIGHT OF WAY NEEDED FOR THE HAMILTON/GRANVILLE INTERSECTION PROJECT; IMPROVEMENT NO. 883; AND TO DECLARE AN EMERGENCY.

WHEREAS, temporary right of way is needed for the Hamilton/Granville intersection project and settlement has been reached with the property owner; and
WHEREAS, it is imperative to move forward with this Settlement so that payment can be made to the property owner this year, and all for the preservation of the public peace, property, health, safety and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That the Mayor is hereby authorized to enter into Settlement with MCDONALD'S USA, LLC, P.O. BOX 182571, Columbus, Ohio 43218-2571, for property known as 110 North Hamilton Road, for temporary right of way needed for the Hamilton/Granville intersection improvement project; Improvement No. 883; Settlement Agreement attached as EXHIBIT A and made a part herein.
Section 2. That funding in the amount of SIX HUNDRED EIGHTY FIVE DOLLARS ($685) was set aside in the 2009 Appropriations to Account No. 101.145.5513, Engineering, Capital - Streets, to cover the herein costs.
Section 3. That additional funding in the amount of FIVE HUNDRED DOLLARS ($500) was also set aside in the 2009 Appropriations to Account No. 101.145.5513, Engineering, Capital - Streets, to cover the balance of the herein costs.
Section 4. That, for the reasons set forth in the preamble hereinabove, this ordinance is declared emergency legislation and shall be in full force and effect immediately upon passage by this Council and on date of signature approval by the Mayor.
