TO AUTHORIZE THE MAYOR TO VACATE A BLANKET EASEMENT FOR OPERATION OF DRAINAGE TILES IN THE CREEKSIDE AREA; AND TO DECLARE AN EMERGENCY

WHEREAS, subsequent storm sewer systems have replaced the need for the  drainage tiles; and
 
WHEREAS, this easement does not require the approval of Planning Commission for vacate purposes as the entire property is now owned by the City of Gahanna; and
 
WHEREAS, it is necessary to remove the easement from the chain of title to the property; and
 
WHEREAS, in order to accomplish necessary transactions on the property as quickly as possible, this vacation needs to be completed in a timely manner, and all for the preservation of the public peace, property, health, safety and welfare;
 
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
 
Section 1.  That the Mayor is hereby authorized to execute any necessary documents to vacate the blanket easement for operation of drainage tiles on original lots 4, 6 and 7 as described in Deed Record 1238, Page 345 of the Franklin County Recorders Office; said vacation more particularly described in EXHIBIT A, and made a part herein.
 
Section 2.  That, for the reasons set forth in the preamble hereinabove, this ordinance is declared emergency legislation and shall be in full force and effect immediately upon passage by this Council and on date of signature approval by the Mayor.
