TO AUTHORIZE THE MAYOR TO ENTER INTO AGREEMENT WITH TIM DONUT U.S. LIMITED, INC., TO REPLACE THE CITY'S 16" WATERLINE WITH DUCTILE IRON; TO SUPPLEMENTALLY APPROPRIATE $33,634; AND TO DECLARE AN EMERGENCY.

WHEREAS, there is a 16 inch waterline running under 365 Agler Road that needs to be replaced with Ductile Iron;
WHEREAS, the City Engineer recommends that the City enter into a Reimbursement Agreement with Tim Donut U.S. Limited, Inc. (Tim Hortons) for the replacement of said pipe;
WHEREAS, since Tim Hortons's is ready to begin work due to the construction season it is imperative to move forward with this legislation all for the preservation of the public peace, health, safety and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That the Mayor is hereby authorized to enter into Reimbursement Agreement with Tim Donut U.S. Limited, Inc., 4150 Tuller Road, Suite 236, Dublin, Ohio 43017, for payment for replacement of a 16 inch waterline; Agreement attached hereto as EXHIBIT A.
Section 2. That funding in the amount of THIRTY THREE THOUSAND SIX HUNDRED THIRTY FOUR, ($33,634.00) is hereby supplementally appropriated from the unencumbered, unappropriated balance of the WSCI Fund to Account No. 652.351.5596, Misc. Water Improvement.
Section 3. That ORD-0001-2003, passed January 2, 2003, is hereby amended to reflect this supplemental appropriation.
Section 4. That, for the reasons set forth in the preamble herein above, this ordinance is declared emergency legislation and shall be in full force and effect immediately upon passage by this Council and on date of signature approval by the Mayor.
